About these terms of use.
By using this E.ON Next Mobile Application (the "Application"), you agree to be bound by these Terms of Use.
Certain features of this Application may require you to be an E.ON Next customer or provide personal information as part of a registration process. Your use of this Application is also subject to our privacy policy which can be seen at eonenergy.com/privacy.
Data Collection and Use.
By using this Application you consent to the collection and use of the information by E.ON Next. We may collect and store any of the following:
An encrypted copy of your E.ON Next email address and password.
Your email address and correspondence sent via the Application.
The unique identifier for your device (we will obtain and hold this to allow push notifications to be sent to the device associated with your account).
Information about how you interact with the Application and the applicable E.ON Next website.
User Control and Un-install.
Methods to un-install this Application will vary depending on your device. To uninstall this Application, please use the application manager provided with your device and consult your device manual.
Security.
The information this Application collects may be stored locally on your device and may be transmitted to our servers. The transmission of information over wireless and wired networks is not inherently secure. E.ON Next uses many tools to help protect your personal information against unauthorised access and disclosure however we do not guarantee that your personal information or private communications will always remain private when using this Application.
Policy Changes.
E.ON Next reserves the right to make changes without notice to our privacy policy, this Application and/or the Terms of Use.
E.ON Next reserves the right to withdraw or suspend usage of this Application at any time without prior notification.
Application Use.
E.ON Next grants you the right to use this Application only for your personal use in compliance with all relevant third party agreements (including but not limited to your wireless data service agreement) and all applicable laws. You may not modify, copy, publish, license, sell, or otherwise deal with this Application or any information or software associated with this Application.
Intellectual Property.
E.ON Next owns, or is the licensee to, all rights, title and interest in and to this Application, including all rights under patent, copyright, trade secret, or trademark law, and any and all other proprietary rights. No rights are transferred by usage of the Application.
Product Claims.
Your mobile provider is not responsible for addressing any claims by you or any third party relating to possession or usage of this Application including but not limited to:
Product liability claims.
Any claim the Application fails to conform to any applicable legal or regulatory requirement; or
Claims arising under consumer protection or similar legislation.
Disclaimer of Warranties.
The Application and the service(s) accessed by it are provided "as is" and "as available" and E.ON Next accepts no responsibility for its usage, security, reliability, performance or any reliance placed on its content.
E.ON Next expressly disclaims to the fullest extent permitted by law all express, implied and statutory warranties.
You download and use this Application at your own risk, and you are solely responsible for any damage to your hardware device(s) or loss of data that results from the download or use of this Application.
Limitation of Liability.
E.ON Next is not liable to you for any use or misuse of this Application to the fullest extent permitted by law.
This limitation of liability applies whether damages arise from use or misuse of and reliance on this Application, from inability to use this Application, or from the interruption, suspension, or termination of this Application.
Nothing in these Terms of Use shall limit or exclude our liability for fraudulent misrepresentation or for death or personal injury resulting from our negligence or for any other liability that cannot be limited or excluded by law.
Jurisdiction.
These terms and conditions shall be subject to the laws of England and subject to the exclusive jurisdiction of the English Courts.
